Research Note: Provenance as Legal Infrastructure — What Our Patent Filing Reveals About AI Governance Gaps

IRAIET's Founder and Research Director Yulia Leshchenko recently filed a patent for verifiable provenance and chain-of-custody management of AI-generated digital objects in decentralized environments.

The research question that motivated it is the same one our governance agenda addresses: what legal infrastructure does AI provenance actually require — and does it currently exist?

The patent — "System and Method for Providing Verifiable Provenance and Chain-of-Custody Management of Digital Evidence for Artificial Intelligence-Generated Digital Objects in Decentralized Environments" — addresses a problem that IRAIET has identified as one of the central infrastructure gaps in AI governance: the absence of a verified, legally defensible record of AI content origin.

This gap has both technical and legal dimensions. Technically, AI-generated content can be produced, modified, and distributed without any embedded record of its origin or the authorizations that governed its creation. Legally, the absence of such a record creates simultaneous exposure under IP frameworks (which require human authorship documentation), transparency regulations (which require provenance disclosure), and enforcement frameworks (which require evidence of origin for dispute resolution).

From 2026 to 2030, expect deeper integration with AI provenance requirements and more jurisdiction-specific strategies as national standards diverge. The California AI Transparency Act's August 2 effective date confirms that regulatory demand for provenance infrastructure has arrived — and that the technical solutions for providing it are now both commercially valuable and legally necessary.

At IRAIET, we believe that the most effective research on AI governance produces frameworks that can be implemented — not only analyzed. This patent filing reflects that belief: the same problem our research identifies as a governance gap, our work addresses as an infrastructure solution.
