Research Update: Digital Assets and Blockchain Systems — Where the Legal Framework Stands in August 2026

The legal framework for digital assets in August 2026 is more developed than it was a year ago — and more fragmented than it needs to be. Here is where IRAIET's research tracking places the current state.
Three developments define the August 2026 landscape for digital asset legal frameworks:
1️⃣ Stablecoin regulation is moving toward finality. The GENIUS Act's implementing rules are in advanced drafting stages across six federal agencies, with the framework expected to take effect January 2027. This represents meaningful progress from the regulatory ambiguity that defined the space 18 months ago — but the cross-border harmonization questions remain open.
2️⃣ Tokenization infrastructure is being patented. The USPTO is granting allowances for blockchain and tokenization patents at an accelerating rate — including, as of June 2026, allowances for AI provenance and chain-of-custody systems in decentralized environments. The competitive dynamics of this patent landscape will shape market structure in the tokenization space.
3️⃣ AI-blockchain convergence is creating governance gaps that no current framework addresses. The intersection of AI and blockchain creates novel legal questions about liability when smart contracts execute AI decisions, IP rights in AI-generated NFTs, and regulatory compliance for decentralized AI systems. These questions are not yet before courts or legislators at scale — but they will be.
IRAIET's Digital Assets and Blockchain Systems research agenda treats these three developments as interconnected — because the most consequential legal questions in this space sit at their intersection.
