The NSA, CISA, and FBI have formally identified AI model distillation as a national security threat.

This reframes AI IP protection as a national security question — and generates research questions that IRAIET is positioned to address.

The joint advisory warns that China-based AI companies have been conducting sustained, large-scale distillation campaigns against US frontier AI providers since late 2024.

From a research perspective, the advisory's most significant contribution is the formal recognition that AI model IP — model weights, training architectures, proprietary capabilities — constitutes an asset class that is both commercially valuable and nationally strategic.

This recognition has direct implications for AI governance research across three dimensions that IRAIET is tracking.

The intersection of national security frameworks and IP law creates novel legal questions about the remedies available when AI IP theft occurs at the national security scale the advisory describes. Traditional IP enforcement mechanisms — trademark and patent litigation, trade secret misappropriation claims — were not designed for adversarial state-level IP theft. What enforcement architecture is adequate to the threat the advisory describes?

The advisory's emphasis on API monitoring as an enforcement mechanism connects directly to the provenance and chain-of-custody infrastructure that IRAIET's founder and research director has developed through her patent filings. The research question is: what technical and legal standards for API monitoring are sufficient to support IP enforcement claims in the threat environment the advisory describes?

And the advisory raises Innovation Policy questions about the trade-offs between API openness — which has driven AI ecosystem development — and the IP protection requirements that the distillation threat creates.
